What is a Continuance Without a Finding?
This disposition is also sometimes referred to as the acronym CWOF (pronounced as “quaff”).
A CWOF is an intermediary disposition sometimes adopted by the court for first and sometimes second or subsequent offenders usually as part of a plea deal.
A CWOF literally means that the court will continue your case without making a finding as to your guilt or innocence. The case would typically be continued for a period of 1-2 years during which you would be on probation and subject to certain probationary terms.
In the event you do not wish to take your case to trial, the benefits to a CWOF are many:
1. You are not forced to proceed to a trial and you would avoid the risks associated with a trial;
2. A CWOF is not a conviction. Thus, provided you successfully complete your probationary terms you can maintain your non-conviction status; and
3. If you successfully complete your probationary term, at the end of the probationary term, the charge is dismissed.
