Today, on Friday 19 May 2023, NOT GUILTY: In Commonwealth of Massachusetts v. Defendant, Docket No. 2167 CR 0829, after trial, my client was found NOT GUILTY of Assault and Battery (A&B), Assault and Battery (A&B) with a Dangerous Weapon, Two Counts of Assault and Battery (A&B) on a Police Officer and Reckless Operation of a Motor Vehicle.*
In this matter my client was charged with attacking a group of people after a road rage incident. My client was suffering at the time from severe mental health disorders. We engaged the services of a leading expert (Psy.D (Doctor) in Clinical Psychology) to provide us with an opinion as to my client’s criminal responsibility (previously referred to as the “insanity defense”) at the time of the incident. Our expert testified that our client suffered from a pre-existing mental health disorder and lacked the ability to conform his actions to the letter of the law or lacked the ability to understand the wrongfulness of his actions thus he lacked criminal responsibility pursuant to the case of Commonwealth v. Mchoul.
