The Restraining Order law, Massachusetts General Laws c. 209A, is meant to be used as a shield to protect individuals from abuse. However, often Restraining Orders are used as a weapon to manipulate the defendant with threats of criminal charges and even incarceration.

You can be charged with Violation of a Restraining Order even if the complainant on the order contacted you or requested to meet with you. You can be charged with Violation of a Restraining Order for e-mail, text messages, written letters, telephone contact or even third party contacts.

Often, charges of Violation of a Restraining Order may be dismissed for the lack of a victim or witness to prosecute. Your spouse may claim the “spousal privilege” allowing them to choose not to testify against you. The alleged victim may refuse to testify based upon the victim’s own Fifth Amendment right to remain silent to avoid self incrimination.
